When the night in the rental apartment gets noisy: What matters when it’s noisy

The music is muted, but voices still penetrate through the wall. Then a door slams shut, and shortly afterwards a deep bass starts playing somewhere. In a Berlin rental apartment, the night can sound very different – depending on who lives next door and what is happening in front of the house.

Those who regularly wake up because of such noises want to know above all: What does living in a densely populated city entail, and when does the annoyance become a rental law problem? There is no one-size-fits-all answer. The origin, course and consequences of the noise make the difference.

When does noise in the apartment become a rental law problem?

A noticeable noise is not yet a breach of the lease. Steps in the stairwell, a brief conversation in the hallway, or occasional furniture moving can be disturbing without significantly restricting the use of the apartment. It can look different if nocturnal music repeatedly prevents sleep or loud arguments are regularly heard in the apartment for an extended period of time. What is decisive is not only how unpleasant the noise is perceived by the affected persons. Particular attention should be paid to its intensity, frequency and duration, the time of day as well as the specific living conditions.

Forms the legal starting point § 536 of the Civil Code: It links a reduction in rent to the fact that the suitability of the rented property for the use agreed upon has been canceled or reduced; an insignificant reduction is not taken into account. Therefore, a precise question helps to classify it more than the label “disturbance of rest”: What can actually no longer be done in which rooms at which times due to the noise as usual? For example, someone who is repeatedly woken up from sleep describes a different impairment than someone who hears voices through an open window for a few minutes.

Neighbor, house or street: Where the noise comes from makes a difference

For the next steps, it is important to narrow down the source as accurately as possible. Does the music come from another apartment, do conversations echo from the stairwell, or does the sound come in from outside? Noise inside a house can be described differently from noises from a construction site on a neighboring property. The question of which influence possibilities the landlord has can also play a role in the legal assessment. Therefore, a nocturnal disturbance from the neighboring apartment and construction work outside the property should not be hastily thrown into the same pot.

A decision of the Federal Supreme Court in case number VIII ZR 31/18 shows how close such differences can be in individual cases. It concerns noise and dirt emissions from a construction site on a neighboring property that occurred later. According to the circumstances dealt with there, these in principle do not constitute a breach of the lease if the landlord has to accept them without the possibility of defense or compensation. This does not imply a general rule that construction noise or other noises from the outside would be legally meaningless under lease law. Especially for this reason, it is worthwhile to first determine where the burden comes from and whether it only occurred later.

What those affected should keep in mind – and who to inform

If you want to describe recurring noise in a comprehensible way, you don’t need a literary description of the sleepless night. Helpful are sober information: On which day did the noise start approximately, how long did it last, how did it sound and from which direction was it perceptible? Did it occur once or several times in a week? The effect also belongs to it – for example, that a conversation in the bedroom could be clearly heard or sleep was repeatedly interrupted. A continuous note can make patterns visible that blur in memory. A detailed noise record is a possible aid, not a rigid prerequisite that only makes every complaint permissible.

The next recipient is the landlord or the responsible property management in matters of rental law. § 536c BGB Regulates the notification of a defect by the tenant. It is practical to notify in a timely manner, which specifically describes the observations and asks for examination. A written message records what was communicated when. It is more helpful than a general accusation against “the neighbors” if the source of the noise is not even clearly established. If you are unsure how to legally classify the recurring disturbance, you can Landlord law lawyer in Berlin To add. Dr. Bartmann Attorneys advise tenants and landlords in Berlin on rental law, among other things.

A conversation with the neighbors can also be useful if the situation seems suitable for it. A concrete observation is more helpful than an assumption: “Yesterday, voices were heard in the bedroom between midnight and one o’clock” leaves room for a solution. However, whether such a conversation is held does not change the fact that a possible deficiency towards the landlord should be reported. Especially when the origin of the noise is unclear, it is fair and appropriate to distinguish between observation and assumption linguistically.

Why a rent reduction is not a spontaneous solo venture

An unsettled night can trigger the desire to immediately transfer less rent. This is understandable, but risky. Whether the prerequisites for a reduction in rent exist and to what extent the useability of the apartment is impaired depends on the specific facts. Tables with fixed reduction rates do not replace this examination: Two cases with similar sounding can differ significantly depending on the duration, living conditions and cause. Even an announced reduction does not create a legal basis on its own.

Anyone who arbitrarily retains an excessively high amount risks rental arrears and further disputes – in addition to the actual noise problem. It is more sensible to describe the disturbances as accurately as possible at first, inform the landlord and record their reaction. This allows you to better assess later which impairment existed and what steps have already been taken. Legal advice is especially helpful when the burden persists, its cause is disputed or a reduction in rent is being considered. It can examine the individual case based on the rental agreement, notifications and course of events, instead of applying a general rate to a specific apartment.

Moving forward more calmly: from conflict to the next meaningful action

Noise conflicts rarely become clearer when several parties are only arguing about who is behaving more sensitively or more recklessly. A simple separation creates more clarity: what was actually heard, when did it happen and what followed the notification? Landlords or property management can react more effectively to this than to the demand that “finally there must be peace”. Those affected can also recognize from their records whether it is individual outliers or whether a recurring burden is developing.

If the conflict persists, the legal classification becomes more important. Dr. Bartmann Attorneys advise and represent tenants, landlords, property management companies and apartment owners in Berlin in rental law matters both extrajudicially and judicially. This can be particularly relevant if there is disagreement about the cause of the noise, the effects on the apartment or the other rights and obligations. The first sensible step remains usually unspectacular: record concrete incidents and communicate them objectively before an premature legal decision is made from an sleepless night. This contribution provides general guidance and does not replace advice on individual cases.
